These Terms of Service, together with any terms presented during a purchase and the Storey Privacy Policy, form a legally binding agreement between you and Better World LLC concerning your access to and use of Storey.

Please read these Terms carefully. They contain important provisions concerning account eligibility, automatically renewing subscriptions, disclaimers, limitations of liability, and the law and courts that govern disputes.

1. Agreement to These Terms

These Terms of Service are referred to as the "Terms."

They apply to:

  • The Storey iOS application, currently titled "Storey: Habits That Rise";
  • Storey accounts and authentication;
  • Storey's habit-tracking, city, building, calendar, reminder, weather, analytics, and subscription features;
  • The Storey website at https://trystorey.com; and
  • Related software, content, features, support, and services.

The application, website, and related services are collectively called the "Service."

The Service is operated by:

In these Terms, "Storey," "Better World," "we," "us," and "our" refer to Better World LLC. "You" and "your" refer to the person accessing or using the Service.

You accept these Terms when you:

  • Download, install, access, or use the Service;
  • Create or access a Storey account;
  • Select a button indicating acceptance;
  • Continue through a sign-in screen that states that continuing constitutes agreement; or
  • Purchase or begin a trial of a Storey subscription.

If you do not agree to these Terms, do not access or use the Service.

If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization. In that circumstance, "you" includes the organization.

2. Privacy Policy

Our collection, use, disclosure, retention, and protection of personal information are described in the Storey Privacy Policy:

The Privacy Policy is incorporated into these Terms by reference. By using the Service, you acknowledge that information will be processed as described in the Privacy Policy.

3. Eligibility

You must be at least 13 years old to create a Storey account or use the account-based Service.

If the minimum age for consenting to online services in your jurisdiction is higher than 13, you must meet that higher age or use the Service only with legally valid authorization from a parent or legal guardian.

If you are under the age of legal majority where you live, you represent that:

  • Your parent or legal guardian has reviewed and agreed to these Terms;
  • Your parent or legal guardian permits you to use the Service; and
  • Your use complies with applicable law.

A parent or guardian who allows a minor to use the Service is responsible for the minor's use and compliance with these Terms.

An App Store age rating describes the nature of an app's content. It does not override the account-eligibility requirements in these Terms.

You may not use the Service if:

  • Applicable law prohibits you from doing so;
  • You are subject to sanctions or trade restrictions that prohibit access;
  • We previously terminated or suspended your access for a material violation, unless we expressly authorize renewed access; or
  • You cannot legally enter into these Terms.

4. Storey Accounts

4.1 Account Creation

At launch, Storey uses Sign in with Apple. You may be required to authenticate through an Apple Account and provide or authorize access to information needed to create and maintain a Storey account.

We may add other authentication methods, including email-based one-time-code authentication.

You agree to provide accurate account information and keep it reasonably current.

4.2 Account Security

You are responsible for:

  • Maintaining control of your Apple Account, email account, device, and device passcode;
  • Protecting authentication credentials and private relay email access;
  • Restricting unauthorized access to your device and Storey account; and
  • Activity occurring through your account unless caused by our breach of these Terms or applicable law.

Do not share authentication codes or permit another person to impersonate you.

Notify us promptly at support@trystorey.com if you believe your account or associated credentials have been compromised.

4.3 One Account per User

Unless we expressly permit otherwise, each account is intended for use by one person. You may not sell, rent, license, transfer, or commercially share your account.

4.4 Apple Private Relay Addresses

If you use Sign in with Apple and choose to hide your email, Apple may provide a private relay address. You are responsible for maintaining the Apple settings necessary to receive communications forwarded through that address.

We are not responsible for communications you do not receive because:

  • You disabled Apple's relay service;
  • Your Apple Account settings are incorrect;
  • Your email provider filtered the message;
  • You lost access to the relevant Apple Account; or
  • Another circumstance outside our reasonable control prevented delivery.

5. The Storey Service

Storey is a habit-tracking tool that visualizes habits as buildings in a digital city. Completing and recording habits may affect progress indicators, streaks, building states, city elements, and related visualizations.

The Service may include:

  • Habit creation and management;
  • Habit names, emojis, colors, and goals;
  • Daily or weekly completion records;
  • Calendar views;
  • Streak and progress calculations;
  • Building and city visualizations;
  • Local notifications and reminders;
  • Approximate local-weather visualizations;
  • Account synchronization;
  • Product analytics and usability monitoring;
  • Free and paid feature tiers; and
  • Other features introduced over time.

Features may vary by app version, device, operating-system version, country or region, subscription status, account status, and technical or legal requirements.

6. Free Tier

Storey's free tier is currently intended to allow up to five active habits.

We may add, remove, or change free features and limits as the Service evolves. Where required by law, we will provide notice before a material change takes effect.

The availability of a free tier does not guarantee that any particular free feature or limit will remain available indefinitely.

We may offer trials, promotional access, grandfathered access, or different feature limits to certain users. Those arrangements do not require us to provide the same arrangement to every user.

7. Storey Pro and Paid Features

At the Effective Date, Storey Pro may be displayed as "coming soon" and may not yet be available for purchase.

If Storey Pro or another paid feature becomes available, the terms in this Section will apply together with the purchase terms shown by Apple and within the app.

7.1 Purchase Information Controls

Before you confirm a purchase, the App Store purchase interface or Storey paywall will display applicable information, which may include:

  • The subscription product;
  • The billing period;
  • The current price and currency;
  • Applicable taxes;
  • The duration of any free trial or promotional offer;
  • The date or conditions on which billing begins;
  • The recurring nature of the subscription; and
  • Instructions or links for managing the subscription.

The price, duration, trial, and billing information displayed at the time you authorize the transaction control over any earlier estimate, marketing statement, planned price, or outdated reference.

7.2 Billing Through Apple

Storey subscriptions purchased in the iOS application are billed by Apple through your Apple Account and the App Store.

Apple, not Better World LLC, processes the payment transaction. We do not receive or store your full payment-card number.

We may receive transaction and entitlement information needed to determine whether your account has access to paid features.

You authorize Apple to charge your selected payment method for the price and taxes presented at purchase.

7.3 Automatic Renewal

A Storey subscription is an automatically renewing subscription unless the purchase screen expressly states otherwise.

Your subscription will renew at the end of each billing period until canceled through Apple.

The renewal price will be the price disclosed by Apple, subject to any price change, consent, notice, tax, currency, or storefront rules administered by Apple and required by applicable law.

7.4 Free Trials and Promotional Offers

We may offer a free trial, introductory price, promotional offer, offer code, or other reduced-price access.

Eligibility may be determined by Apple, Storey, or both. Eligibility may depend on factors such as:

  • Whether you previously subscribed;
  • Whether you previously used a trial;
  • Your App Store account;
  • Your country or region;
  • The subscription group; or
  • The terms of the particular promotion.

Unless the purchase screen says otherwise, a free trial automatically converts to a paid subscription at the price and billing interval displayed when you started the trial.

To avoid being charged, cancel through Apple before the trial expires and within any cancellation deadline Apple displays.

Unused portions of a trial or promotional period may be forfeited when you purchase another subscription, change plans, or otherwise become ineligible, subject to Apple's rules and applicable law.

7.5 Cancellation

You may cancel a subscription through Apple's subscription-management interface.

On an iPhone, this is generally available through:

Settings → your name or Apple Account → Subscriptions → Storey → Cancel Subscription

Cancellation prevents future renewal. Unless Apple or applicable law provides otherwise, cancellation does not immediately end access already paid for; paid access generally continues until the end of the current billing period.

You must cancel through the Apple Account that purchased the subscription.

Deleting the Storey app does not cancel a subscription.

Deleting your Storey account does not automatically cancel an Apple subscription.

You are responsible for canceling the subscription separately through Apple.

7.6 Refunds

Purchases made through the App Store are subject to Apple's billing and refund policies.

Better World LLC cannot directly reverse an App Store charge or guarantee a refund for a transaction processed by Apple.

You may request a refund from Apple through Apple's applicable refund process. Apple determines refund eligibility, except where Better World LLC is required to provide a remedy under applicable law or the Apple-required terms in Section 31.

Nothing in these Terms limits any non-waivable refund, cancellation, withdrawal, or consumer right.

7.7 Price Changes

Subscription prices may change.

Apple may provide notice or request consent where required. If you do not agree to a price change, you must cancel before the changed price takes effect.

If a price change requires consent and you do not provide it, Apple may prevent renewal or terminate the subscription as provided by Apple's rules.

7.8 Taxes and Currency

Prices may exclude or include taxes depending on your App Store storefront and applicable law.

Apple may calculate, collect, remit, or display taxes and currency conversions. Currency exchange rates, bank charges, payment-provider charges, and taxes may affect the amount you pay.

7.9 Restoring Purchases

If supported, you may use Storey's restore-purchases functionality to ask Apple to verify an existing entitlement.

Restoration depends on:

  • The Apple Account used for purchase;
  • Apple's transaction records;
  • Network availability;
  • Storey's current subscription configuration; and
  • Applicable App Store rules.

7.10 Subscription Expiration

When a subscription expires or is canceled:

  • Access to paid features may end;
  • The free-tier limits and functionality may apply;
  • Some premium views, controls, customization, or functionality may become unavailable; and
  • Account and habit data will be handled as described in the Privacy Policy.

Cancellation does not entitle you to continued access to paid features after the applicable paid period ends.

7.11 Family Sharing

A subscription will be available through Family Sharing only if Storey and Apple expressly support Family Sharing for that subscription. Do not assume that a subscription can be shared unless the App Store indicates that it can.

8. License to Use Storey

Subject to your compliance with these Terms, Better World LLC grants you a limited, personal, revocable, non-exclusive, non-sublicensable, and non-transferable license to:

  • Download and install the Storey application on Apple-branded products that you own or control; and
  • Access and use the Service for your personal, non-commercial use.

Your use must comply with:

  • These Terms;
  • The Apple Media Services Terms and Conditions;
  • Applicable App Store usage rules;
  • Applicable third-party terms; and
  • Applicable law.

The application is licensed, not sold.

The license does not transfer ownership of Storey, its software, or any Better World intellectual property.

Where permitted by Apple's applicable usage rules, Storey may be accessed by other accounts associated with a purchaser through Family Sharing, volume purchasing, or other Apple-supported access mechanisms.

9. License Restrictions

Except where applicable law expressly permits conduct that cannot be contractually restricted, you may not:

  • Copy, reproduce, distribute, publicly display, publicly perform, sell, lease, sublicense, or commercially exploit the Service;
  • Reverse engineer, decompile, disassemble, decrypt, derive source code from, or attempt to discover the source code or underlying structure of the Service;
  • Modify, adapt, translate, create derivative works from, or remove notices from the Service;
  • Circumvent subscription controls, account restrictions, rate limits, security controls, or technical-protection measures;
  • Access non-public systems, data, accounts, APIs, or administrative functionality without authorization;
  • Use automated scripts, bots, crawlers, scrapers, or similar means to access or extract information from the Service without our written permission;
  • Interfere with the Service's operation, availability, security, integrity, or performance;
  • Introduce malicious code, malware, ransomware, spyware, corrupted data, or harmful instructions;
  • Conduct vulnerability scanning, penetration testing, or security research without our prior written authorization;
  • Use Storey branding in a way that falsely implies endorsement, affiliation, or partnership;
  • Use the Service to create, benchmark, train, or improve a competing commercial product through unauthorized extraction or copying;
  • Resell access to the Service;
  • Attempt to obtain another user's credentials or account information; or
  • Help another person engage in prohibited conduct.

A restriction in this Section applies only to the maximum extent permitted by applicable law.

10. User Content

10.1 Your Content

"User Content" includes information and material you enter, upload, create, record, or store through the Service, including:

  • Habit names;
  • Emojis;
  • Colors;
  • Goals;
  • Completion records;
  • Calendar entries;
  • Notes, if supported;
  • Support attachments; and
  • Other user-submitted information.

As between you and Better World LLC, you retain ownership of your User Content.

10.2 Limited Operational License

You grant Better World LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, format, transmit, display, and otherwise use User Content solely as reasonably necessary to:

  • Provide the Service;
  • Synchronize and display your information;
  • Operate habit and city functionality;
  • Maintain security and integrity;
  • Prevent abuse;
  • Provide support;
  • Comply with law;
  • Enforce these Terms; and
  • Improve and maintain the Service in accordance with the Privacy Policy.

This license allows us to use service providers that process User Content on our behalf for those purposes.

This license does not grant us the right to use your private habit content in public advertising or sell it to data brokers.

The license ends when the relevant User Content is deleted from active systems, except to the extent:

  • Retention temporarily continues in backups;
  • Retention is required or permitted by law;
  • The information has been de-identified so it is no longer reasonably linked to you;
  • The information is necessary to resolve a dispute or enforce these Terms; or
  • A service provider retains data under its own lawful retention obligations.

10.3 Your Responsibilities

You represent and warrant that:

  • You own User Content or have the rights necessary to provide it;
  • Your User Content and our permitted processing of it do not violate law or another person's rights;
  • Your User Content does not contain malicious code;
  • You will not use User Content fields to harass, threaten, exploit, or unlawfully target another person; and
  • You will not enter information that you are legally prohibited from providing.

10.4 Sensitive Information

Storey does not require you to enter medical records, financial-account numbers, government identification numbers, passwords, or similarly sensitive information.

You are responsible for deciding what to name and record as a habit. Avoid entering highly sensitive information that is unnecessary to use the Service.

10.5 Moderation and Removal

Storey is primarily a private habit-tracking service. We are not obligated to review all User Content.

We may restrict, remove, preserve, or disclose User Content where we reasonably believe it is necessary to:

  • Operate or secure the Service;
  • Investigate a violation;
  • Prevent harm or unlawful activity;
  • Respond to valid legal process;
  • Protect rights or safety; or
  • Comply with law.

11. Feedback

If you provide ideas, suggestions, proposals, designs, feature requests, or other feedback about Storey, you grant Better World LLC a worldwide, perpetual, irrevocable, sublicensable, transferable, royalty-free license to use, reproduce, modify, disclose, distribute, commercialize, and otherwise exploit that feedback without restriction or compensation.

This Section does not transfer ownership of private User Content merely because you contact support.

12. Better World Intellectual Property

The Service and all associated intellectual property are owned by Better World LLC or its licensors, including:

  • Software and source code;
  • Interfaces and interaction design;
  • Building and city systems;
  • Graphics, illustrations, animations, and visual assets;
  • Layouts, typography, and visual presentation;
  • Logos, names, slogans, and trade dress;
  • Documentation and written content;
  • Databases and compilations;
  • Analytics configurations; and
  • Updates, improvements, and derivative works.

"Storey," "Storey: Habits That Rise," associated logos, and related branding may be trademarks or service marks of Better World LLC.

No right is granted to use Better World LLC's names, marks, logos, domains, or trade dress except as necessary to accurately identify the Service or with our prior written permission.

All rights not expressly granted are reserved.

13. Copyright and Intellectual-Property Complaints

If you believe content available through the Service infringes your copyright or other intellectual-property rights, contact:

Your notice should include:

  1. Identification of the protected work or right;
  2. Identification and location of the allegedly infringing material;
  3. Your contact information;
  4. A statement of your good-faith belief that the use is unauthorized;
  5. A statement that the information in the notice is accurate;
  6. A statement, under penalty of perjury where applicable, that you are authorized to act for the rights holder; and
  7. Your physical or electronic signature.

We may request additional information before acting on a complaint.

14. Acceptable Use

You agree not to use the Service to:

  • Violate any law, regulation, court order, or legally binding obligation;
  • Infringe intellectual-property, privacy, publicity, confidentiality, contractual, or other rights;
  • Harass, threaten, stalk, exploit, defame, discriminate against, or harm another person;
  • Facilitate fraud, impersonation, deception, or identity theft;
  • Collect information about another person without lawful authority;
  • Transmit unsolicited commercial messages or spam;
  • Promote or facilitate violence, abuse, exploitation, or illegal conduct;
  • Interfere with another person's use of the Service;
  • Attempt unauthorized access to accounts or systems;
  • Circumvent account, subscription, security, or technical restrictions;
  • Overload, disrupt, damage, or degrade the Service;
  • Misrepresent your identity, affiliation, authority, or relationship with Better World LLC;
  • Submit false reports or abuse support or privacy-request processes; or
  • Use the Service in a manner that creates unreasonable legal, security, operational, or reputational risk.

We may investigate suspected violations and cooperate with lawful investigations.

15. Habit Tracking Is Not Medical or Professional Advice

Storey is a general-purpose habit-tracking and visualization tool.

Storey is not:

  • A medical device;
  • A healthcare provider;
  • A mental-health service;
  • A diagnosis or treatment service;
  • A substitute for a physician, therapist, pharmacist, dietitian, attorney, accountant, financial adviser, or other qualified professional;
  • An emergency-response service; or
  • A guarantee of any health, financial, educational, productivity, or behavioral outcome.

Information, reminders, streaks, goals, visualizations, and other features are provided for general informational and organizational purposes.

Do not use Storey as the sole system for:

  • Medication dosing or administration;
  • Medical treatment compliance;
  • Emergency or safety-critical reminders;
  • Monitoring a medical condition;
  • Suicide-prevention or crisis intervention;
  • Legal or regulatory deadlines;
  • Financial transactions;
  • Child, elder, or dependent-care safety;
  • Workplace safety procedures; or
  • Any task where a missed, delayed, duplicated, or incorrect notification could cause injury, death, legal harm, or substantial loss.

Consult an appropriately qualified professional regarding medical, mental-health, legal, financial, or other professional concerns.

If you believe you are experiencing an emergency, contact local emergency services.

16. No Guaranteed Outcomes

Storey does not guarantee that you will:

  • Form or break a habit;
  • Maintain a streak;
  • Reach a goal;
  • Improve health, fitness, finances, productivity, education, or wellbeing;
  • Receive a particular result from reminders or visualizations; or
  • Continue using the Service consistently.

Habit formation and outcomes depend on many factors outside our control.

Any examples, testimonials, illustrations, projections, or marketing statements are not guarantees of typical or future results.

17. Notifications and Reminders

Notifications are optional and may be generated locally on your device.

Notifications may be delayed, suppressed, duplicated, misconfigured, or not delivered because of device settings, Focus modes, battery optimization, operating-system behavior, time-zone changes, device clock settings, app permissions, app updates, uninstallation, software errors, or circumstances outside our control.

You are responsible for checking and maintaining your notification settings.

Do not rely on Storey reminders for medical, legal, financial, emergency, or safety-critical obligations.

Notification text may be visible to anyone with access to your lock screen or device.

18. Weather and Location-Based Visuals

Storey may estimate a coarse city-level location from your Internet Protocol address and use approximate coordinates to obtain weather information for visual effects such as an animated sky.

Weather and location information may be delayed, incomplete, inaccurate, or unavailable.

Storey's weather display is decorative and informational. It is not intended for severe-weather alerts, emergency planning, aviation, marine navigation, outdoor-safety decisions, agricultural decisions, travel safety, or any decision requiring authoritative weather information.

Use an official or professionally appropriate weather source for safety-related decisions.

19. Analytics and Session Reconstruction

Storey may use product analytics and usability tools, including Microsoft Clarity, as described in the Privacy Policy.

These tools may process app interactions, screen structure, gestures, performance information, session metadata, and approximate region information.

We intend to configure masking and sanitization controls designed to prevent User Content from being included in session-reconstruction data. No safeguard is guaranteed to be perfect.

By using the Service, you acknowledge that analytics processing may occur as described in the Privacy Policy, subject to applicable consent and opt-out requirements.

20. Third-Party Services

The Service relies on or interacts with third-party services that may include:

  • Apple;
  • Sign in with Apple;
  • Apple App Store and StoreKit;
  • Supabase;
  • Amazon Web Services infrastructure used by Supabase;
  • Microsoft Clarity;
  • ipapi.co;
  • Open-Meteo;
  • GitHub Pages;
  • Internet, telecommunications, and device-platform providers; and
  • Other vendors disclosed in the Privacy Policy.

Your use of third-party services may be governed by separate terms and privacy policies.

You must comply with applicable third-party agreements when using Storey, including your wireless-data, Internet-service, Apple, and App Store agreements.

We do not control and are not responsible for:

  • Third-party service availability;
  • Third-party acts or omissions;
  • Third-party changes;
  • Third-party security incidents;
  • Apple Account restrictions;
  • App Store billing decisions;
  • Third-party content; or
  • Third-party terms and privacy practices.

Nothing in this Section excludes responsibility that cannot legally be excluded.

21. External Links

The Service may contain links to third-party websites or resources.

Links are provided for convenience and do not imply endorsement.

We are not responsible for third-party content, products, services, security, availability, or practices. Your dealings with third parties are solely between you and the third party.

22. Updates and Changes to the Service

We may:

  • Add, modify, suspend, or discontinue features;
  • Release updates, patches, or new versions;
  • Change technical requirements;
  • Change free or paid tiers;
  • Change supported devices or operating systems;
  • Replace service providers;
  • Modify visual systems and calculations;
  • Limit access to protect security or integrity; or
  • Discontinue the Service.

We will provide notice of material changes where required by law.

Certain updates may be required to continue using the Service. Failure to install an update may result in reduced functionality, incompatibility, security risk, or loss of access.

We do not guarantee backward compatibility with every device, operating-system version, app version, or data format.

23. Beta, Experimental, and Preview Features

We may identify features as beta, preview, experimental, early access, or similar.

Those features may be incomplete, change without notice, contain errors, perform unpredictably, be unavailable, lose data, be subject to additional terms, or be discontinued.

Do not rely on beta or experimental features for important or safety-critical purposes.

24. Service Availability

We aim to operate Storey reliably, but the Service may be interrupted or unavailable because of maintenance, updates, provider outages, network failures, security incidents, high demand, software errors, legal restrictions, natural disasters, or other circumstances.

We do not guarantee continuous, uninterrupted, timely, secure, or error-free operation.

We may impose reasonable usage, storage, rate, or technical limits to maintain security and service quality.

25. Data Integrity and Backups

We use measures designed to protect data, but no system is immune from corruption, loss, unauthorized access, synchronization failure, or deletion.

You are responsible for maintaining independent records of information that is important to you where reasonably possible.

We do not guarantee that:

  • Every completion will synchronize;
  • Every streak or calculation will be correct;
  • Deleted information can be recovered;
  • Data will remain available indefinitely; or
  • A particular historical view will remain unchanged.

26. Account Deletion

You may delete your account through:

Storey → Settings → Delete Account

Account deletion is intended to permanently delete your Storey account and associated habit data from Storey's active server-side database.

Deletion cannot be undone.

Deleting your account may not immediately remove information from temporary backups, security logs, legal records, transaction records, de-identified analytics, third-party systems not directly linked to your account, or records we are required or permitted to retain.

Additional details are provided in the Privacy Policy.

Deleting your Storey account does not cancel an Apple subscription. You must separately cancel through Apple.

27. Suspension and Termination by Better World LLC

We may suspend, restrict, or terminate your access where we reasonably believe:

  • You materially or repeatedly violated these Terms;
  • Your account creates a security risk;
  • Your account is involved in fraud, abuse, unauthorized access, or unlawful conduct;
  • Suspension is necessary to protect users, Better World LLC, or third parties;
  • We are required to act by law, court order, or a service provider;
  • Payment entitlement is invalid, revoked, refunded, or fraudulent;
  • Continued service is technically or commercially impracticable; or
  • The Service or relevant feature is discontinued.

Where reasonable and legally permitted, we may provide notice and an opportunity to cure before termination.

We may act immediately where delay could create risk, harm, liability, or legal noncompliance.

Termination does not eliminate obligations or liabilities that arose before termination.

28. Effect of Termination

When these Terms or your account terminate:

  • Your license to use the Service ends;
  • You must stop accessing restricted portions of the Service;
  • Paid-feature access may end subject to the applicable billing period and Apple's rules;
  • We may delete User Content as described in the Privacy Policy;
  • Outstanding payment obligations remain due; and
  • Provisions that by their nature should survive will remain effective.

Sections concerning ownership, feedback, payment obligations, disclaimers, limitations of liability, indemnification, dispute resolution, Apple terms, and general legal provisions survive termination.

29. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS."

BETTER WORLD LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE;
  • NON-INFRINGEMENT;
  • QUIET ENJOYMENT;
  • ACCURACY;
  • RELIABILITY;
  • AVAILABILITY;
  • SECURITY;
  • DATA INTEGRITY; AND
  • RESULTS.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
  • DEFECTS WILL BE CORRECTED;
  • DATA WILL NEVER BE LOST OR CORRUPTED;
  • NOTIFICATIONS WILL BE DELIVERED;
  • ANALYTICS OR WEATHER INFORMATION WILL BE ACCURATE;
  • THE SERVICE WILL MEET YOUR REQUIREMENTS;
  • THE SERVICE WILL WORK WITH EVERY DEVICE OR OPERATING SYSTEM; OR
  • USE OF THE SERVICE WILL PRODUCE A PARTICULAR OUTCOME.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER WORLD LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF:

  • PROFITS;
  • REVENUE;
  • BUSINESS;
  • OPPORTUNITY;
  • GOODWILL;
  • USE;
  • DATA;
  • USER CONTENT;
  • STREAKS;
  • PROGRESS RECORDS; OR
  • OTHER INTANGIBLE LOSSES.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, STATUTE, OR OTHERWISE, AND EVEN IF A PARTY WAS ADVISED THAT DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF BETTER WORLD LLC AND THE OTHER RELEASED PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO BETTER WORLD LLC THROUGH THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. ONE HUNDRED UNITED STATES DOLLARS (US $100).

The exclusions and cap do not apply to liability that cannot lawfully be excluded or limited. Depending on applicable law, this may include liability for:

  • Fraud;
  • Willful misconduct;
  • Gross negligence;
  • Death or personal injury caused by negligence;
  • Violation of certain statutory rights; or
  • Other non-waivable obligations.

The limitations apply even if a limited remedy fails of its essential purpose.

You acknowledge that the disclaimers and limitations are a reasonable allocation of risk and an essential basis of these Terms.

31. Apple App Store Terms

This Section applies when you download or use Storey through Apple's App Store.

31.1 Agreement Is Between You and Better World LLC

These Terms are between you and Better World LLC, not Apple.

Better World LLC, not Apple, is solely responsible for Storey and its content, subject to these Terms and applicable law.

31.2 Scope of License

Your license is limited to a non-transferable license to use Storey on Apple-branded products that you own or control, as permitted by Apple's applicable usage rules.

Storey may be accessed or used by other accounts associated with a purchaser only where permitted through Apple-supported Family Sharing, volume purchasing, Legacy Contacts, or similar mechanisms.

31.3 Maintenance and Support

Better World LLC is responsible for maintenance and support services for Storey to the extent required by these Terms or applicable law.

Apple has no obligation to furnish maintenance or support services for Storey.

31.4 Warranty

To the extent a warranty cannot legally be disclaimed, Better World LLC is responsible for that warranty.

If Storey fails to conform to an applicable warranty, you may notify Apple. Apple may refund the purchase price paid for the application, if any, in accordance with Apple's obligations.

To the maximum extent permitted by law, Apple has no other warranty obligation concerning Storey.

Better World LLC is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty, subject to these Terms and applicable law.

31.5 Product Claims

Better World LLC, not Apple, is responsible for addressing claims by you or a third party concerning Storey or your possession or use of Storey, including:

  • Product-liability claims;
  • Claims that Storey fails to comply with a legal or regulatory requirement; and
  • Claims under consumer-protection, privacy, or similar laws.

Nothing in these Terms limits Better World LLC's responsibility beyond what applicable law permits.

31.6 Intellectual-Property Claims

If a third party claims that Storey or your possession or use of Storey infringes that party's intellectual-property rights, Better World LLC, not Apple, is responsible for investigating, defending, settling, and resolving the claim, subject to applicable law.

31.7 Legal Compliance

You represent and warrant that:

  • You are not located in a country or region subject to a United States Government embargo or designated by the United States Government as supporting terrorism; and
  • You are not listed on a United States Government list of prohibited or restricted parties.

31.9 Third-Party Terms

You must comply with applicable third-party agreements when using Storey, including Apple's terms and your wireless-data and Internet-service agreements.

31.10 Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.

When you accept these Terms, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

32. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Better World LLC and its members, managers, officers, employees, contractors, agents, licensors, and service providers from claims, liabilities, damages, judgments, losses, penalties, costs, and reasonable legal fees arising from:

  • Your unlawful or unauthorized use of the Service;
  • Your material breach of these Terms;
  • Your User Content;
  • Your infringement or violation of another person's rights; or
  • Fraud, willful misconduct, or negligence attributable to you.

You are not required to indemnify a party for that party's own fraud, willful misconduct, gross negligence, or liability that cannot legally be shifted to you.

We may assume control of the defense of a covered matter. You agree to reasonably cooperate and not settle a claim imposing liability or an admission on Better World LLC without our written consent.

This Section may not apply to consumers in jurisdictions that prohibit or limit consumer indemnification obligations.

33. Informal Dispute Resolution

Before filing a lawsuit, you and Better World LLC agree to make a good-faith effort to resolve the dispute informally.

A party initiating a dispute must send a written notice describing:

  • The party's name and contact information;
  • The Storey account email, if applicable;
  • The facts giving rise to the dispute;
  • The legal or contractual basis of the claim; and
  • The relief requested.

The parties will attempt to resolve the dispute for at least 30 days after receipt of a sufficiently detailed notice before filing suit, unless:

  • A limitation period would expire;
  • Emergency or injunctive relief is reasonably necessary;
  • A party seeks relief in small-claims court; or
  • Applicable law prevents enforcement of this process.

This informal process does not prevent either party from reporting a matter to a regulator, law-enforcement agency, or consumer-protection authority.

34. Governing Law and Courts

These Terms and disputes arising out of or relating to these Terms or the Service are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Subject to non-waivable law, the parties consent to exclusive jurisdiction and venue in:

  • The state courts located in Ingham County, Michigan; and
  • The federal courts with jurisdiction over Ingham County, Michigan.

You and Better World LLC waive objections based on personal jurisdiction, venue, or inconvenient forum in those courts, to the extent legally permitted.

If you are a consumer, this Section does not deprive you of mandatory protections or the right to bring a claim in another forum where the law of your place of residence does not permit that right to be waived.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

35. Time Limit for Claims

To the maximum extent permitted by law, a claim arising out of or relating to these Terms or the Service must be filed within one year after the claim accrued.

A claim not filed within that period is permanently barred.

This Section does not apply where applicable law requires a longer period or prohibits contractual shortening of limitation periods.

36. Injunctive Relief

A breach involving intellectual property, confidential information, unauthorized system access, security controls, or misuse of the Service may cause harm that monetary damages cannot adequately remedy.

Subject to applicable law, either party may seek temporary, preliminary, or permanent injunctive or equitable relief without waiving other available remedies.

37. Export Controls and Sanctions

You must comply with United States and other applicable export-control, import, sanctions, and trade laws.

You may not access, export, re-export, transfer, or use the Service in violation of those laws.

You represent that you are not prohibited from receiving the Service under applicable sanctions or restricted-party rules.

38. Electronic Communications

You consent to receive agreements, notices, disclosures, receipts, and other communications electronically, including through:

  • The Service;
  • The website;
  • Email;
  • Apple-provided interfaces; or
  • Device notifications.

Electronic communications satisfy legal requirements that communications be in writing, except where applicable law requires another method.

You are responsible for maintaining a valid method of receiving account communications.

Marketing communications, if any, will be subject to applicable consent and opt-out requirements.

39. Changes to These Terms

We may update these Terms to reflect changes in:

  • The Service;
  • Features or subscriptions;
  • Service providers;
  • Security practices;
  • Business operations;
  • Applicable law; or
  • Legal or regulatory requirements.

We will update the "Last Updated" date when the Terms change.

If a change is material, we may provide additional notice through the Service, website, email, paywall, sign-in flow, or another reasonable method.

Changes apply prospectively from their effective date unless law requires otherwise.

If you do not agree to updated Terms, you must stop using the Service and may delete your account.

Your continued use after updated Terms become effective constitutes acceptance to the extent permitted by law.

Changes to subscription price or billing will also be handled through Apple where applicable.

40. Assignment

You may not assign or transfer these Terms or your account without our prior written consent.

Better World LLC may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, financing, sale of assets, change of control, or transfer of the Service, provided that the assignment complies with applicable law.

An unauthorized assignment is void.

41. Force Majeure

Better World LLC is not liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, governmental action, sanctions, utility or network failure, cloud-provider outage, App Store interruption, cyberattack, telecommunications failure, or failure of third-party infrastructure.

This Section does not excuse obligations that applicable law does not permit us to excuse.

42. Severability

If a court finds a provision of these Terms invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted and modified only as necessary to make it enforceable.

The remaining provisions will remain in effect.

If modification is not legally permitted, the invalid portion will be severed without affecting the rest of the Terms.

43. No Waiver

A failure or delay in enforcing a provision is not a waiver.

A waiver must be in writing and signed by an authorized representative of Better World LLC.

A waiver on one occasion does not waive the same or another provision on a later occasion.

44. No Agency or Employment Relationship

These Terms do not create a partnership, joint venture, employment, fiduciary, franchise, or agency relationship between you and Better World LLC.

Neither party may bind the other except as expressly stated.

45. Third-Party Beneficiaries

Except for Apple and its subsidiaries as expressly stated in Section 31, these Terms do not create rights for any third-party beneficiary.

46. Entire Agreement

These Terms, the Privacy Policy, purchase terms shown at checkout, and any additional terms expressly applicable to a feature constitute the entire agreement between you and Better World LLC concerning the Service.

They supersede prior or contemporaneous understandings concerning the same subject.

If additional terms conflict with these Terms, the additional terms control only for the feature or transaction to which they apply.

Apple's purchase and billing terms control Apple's processing of App Store transactions.

47. Interpretation

Headings are for convenience and do not limit interpretation.

"Including" means "including without limitation."

A reference to "law" includes applicable statutes, regulations, rules, orders, and legally binding requirements.

The singular includes the plural and the plural includes the singular where context permits.

These Terms will not be interpreted against a party solely because that party drafted them.
